Pumplify (“we,” “us,” or “our”) provides a cryptocurrency application programming interface (“API”) and related services through our platform accessible at pumplify.fun (the “Platform”). These Terms of Service (“Terms”) are a legally binding agreement between Pumplify and you (“User” or “you”) governing your access to and use of the Pumplify API and Platform. By accessing or using Pumplify’s API or services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use the Pumplify Platform or API.
1. General Information
Independent Platform: Pumplify (accessible at pumplify.fun) is an independent crypto API provider. We are not affiliated with Pump.fun, Raydium, Helius, Dexscreener, CoinGecko, Jito, or any other third-party platforms or services. Any references or integrations involving Pump.fun, Raydium, Helius, Dexscreener, CoinGecko, Jito, or others are for functionality purposes only and do not imply any partnership, endorsement, or sponsorship by Pumplify.
Global Applicability: These Terms apply to all users worldwide, regardless of your location or jurisdiction. They outline the legal relationship between you and Pumplify and govern your use of the Platform and API. You are responsible for ensuring that your use of Pumplify is in compliance with any local laws or regulations applicable to you. By using the Platform or API, you represent that you have the legal capacity to enter into this agreement (e.g. you are not a minor in your jurisdiction, and if you are using Pumplify on behalf of an organization, you have authority to bind that organization).
2. Prohibited Uses
You agree not to misuse Pumplify’s API or Platform. Any of the following uses or activities are strictly prohibited:
Illegal Activities: Using Pumplify for any unlawful purpose or in furtherance of illegal activities. This includes, but is not limited to, money laundering, terrorist financing, fraud, or violating any law or regulation through your use of the API. You must not use the API to conduct or facilitate any fraudulent or otherwise illegal transactions.
Malicious Actions: Engaging in any malicious actions targeting Pumplify or its systems. You must not introduce viruses, malware, or any other harmful code, nor attempt to hack, disrupt, overburden, or interfere with the normal functioning and security of the Platform or API. Attempts to gain unauthorized access to Pumplify’s networks, servers, or other users’ accounts or data are strictly forbidden.
Abuse of API: Misusing the API in any way not authorized by Pumplify. You may not attempt to circumvent API usage limits, use automated scripts or scraping in a manner that violates our guidelines, or otherwise abuse the API. Any use of the API that impersonates any person or entity, or misrepresents your affiliation with any person or entity, is prohibited.
Other Harmful Behavior: Using the Platform or API to harass, abuse, or harm another person or entity, or to engage in any activity that is defamatory, obscene, invasive of another’s privacy, or otherwise objectionable or that could expose Pumplify or its users to any harm or liability.
Any violation of these Prohibited Uses may result in immediate suspension or termination of your access (see Section 9 below) and may subject you to legal consequences.
3. Liability Disclaimer
Use at Your Own Risk: The Pumplify Platform and API are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied. To the fullest extent permitted by law, Pumplify disclaims all warranties and representations, whether express, implied, or statutory, including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the API or Platform will be uninterrupted, error-free, or free of harmful components, or that any data or content obtained through our service will be accurate or reliable.
Third-Party Platforms: Pumplify integrates with or provides data related to third-party platforms like Pump.fun and Raydium, but we have no control over those services. Pumplify is not liable for any actions, errors, or omissions of Pump.fun, Raydium, Helius, Dexscreener, CoinGecko, Jito, or any other third-party platform. Any transactions, interactions, or disputes that involve third-party platforms (even if facilitated through Pumplify’s API) are solely between you and the relevant third party. Pumplify makes no warranties or representations about third-party services, and your use of third-party platforms is at your own risk and subject to those third parties’ terms of service.
Blockchain Risks: You acknowledge that using Pumplify involves interacting with blockchain networks, which carry inherent risks (see Section 7 Risk Acknowledgment). Pumplify is not responsible for and will not be held liable for any losses or damages arising from blockchain-related issues, such as network outages, transaction failures, wallet vulnerabilities, or cryptocurrency volatility. You assume full responsibility for all consequences of your use of the API and any blockchain transactions you initiate.
Limitation of Liability: To the maximum extent permitted by applicable law, Pumplify and its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, resulting from or in connection with your use of (or inability to use) the Platform or API, even if we have been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain liabilities, our liability will be limited to the fullest extent permitted by law. In all cases, Pumplify’s total liability for any claim arising out of or relating to these Terms or your use of the API will not exceed the amount of fees you paid to Pumplify for the use of the API in the 12 months preceding the event giving rise to the claim (or, if no fees have been paid, $0 USD).
No Financial Advice: Pumplify does not provide investment or financial advice. Any data or information available through the API (including market data, transaction details, or analytics) is for informational purposes only. You are solely responsible for any decisions you make based on such information, and you understand that Pumplify is not responsible for any outcomes of those decisions.
4. Fees and Payments
Automatic Fees: By using the Pumplify API or Platform, you agree to any applicable fees and charges. Fees may be automatically applied or deducted as set forth on our Fee Disclosure page (available on our website). For example, Pumplify may charge a fee per transaction, a percentage of transaction amounts, or other usage-based fees. It is your responsibility to review the Fee Disclosure page to understand what fees apply to your use of the API. All fees are charged in the manner described (for instance, automatically debited from transactions or billed periodically), and are non-refundable except as required by law.
Changes to Fees: Pumplify reserves the right to modify its fee structure or introduce new fees at any time. We may also introduce paid subscription plans or premium features in the future. If any new fees or paid plans are implemented, we will update the Fee Disclosure page and/or provide notice to users in accordance with applicable legal requirements. Your continued use of the API after any fee changes become effective constitutes your agreement to pay the updated fees. If you do not agree to a fee change, you must stop using the API before the new fees apply.
Payment Methods: You must provide and maintain accurate billing information if required to pay fees (for example, a valid cryptocurrency wallet address or other payment method). You authorize Pumplify to charge any applicable fees using your provided payment method. If your payment method fails or your account is past due, we may suspend or terminate your access to the API after providing notice and an opportunity to cure, if required by law.
Taxes: All fees are exclusive of any taxes, levies, or duties imposed by taxing authorities. You are responsible for any taxes (such as sales, use, value-added tax, or withholding taxes) applicable to your use of Pumplify, other than taxes on Pumplify’s income. We reserve the right to calculate and collect taxes as required by law.
5. Indemnification
You agree to hold harmless, defend, and indemnify Pumplify and its officers, directors, employees, contractors, agents, affiliates, and subsidiaries (the “Pumplify Parties”) from and against any and all claims, liabilities, losses, damages, judgments, awards, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) that arise out of or relate to your use of the API or Platform or your violation of these Terms or any applicable law. This indemnification obligation includes, but is not limited to, claims brought by third parties arising from:
Your Use or Misuse of Pumplify: Any use of the API or Platform by you (or through your account) that causes harm or damage to any person or entity, or violates any law or regulation.
Violation of Terms: Your breach of any provision of these Terms.
Violation of Rights or Law: Your violation of any rights of any other person or entity (such as intellectual property, privacy, or other rights) or violation of any applicable laws or regulations in connection with your use of Pumplify.
Pumplify reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with Pumplify’s defense of such claims. You agree not to settle any such matter without the prior written consent of Pumplify. Your obligation to indemnify Pumplify will survive any termination of these Terms or your use of the Platform.
6. Third-Party Links & Resources
The Pumplify Platform and documentation may contain links to third-party websites, resources, or promotions (including those related to Pump.fun, Raydium, or others). These links and resources are provided for your convenience only, and Pumplify does not endorse, vet, or assume any responsibility for any third-party content, information, products, or services.
No Endorsement: A link to or integration with a third-party platform (such as Raydium or Pump.fun) does not mean that Pumplify endorses or sponsors that third party, nor that the third party endorses Pumplify. Pumplify is not responsible for the accuracy, reliability, or quality of any content, data, products, or services provided by third parties, even if accessed via our API or Platform. We have no control over the practices or policies of third-party sites or services.
User’s Own Risk: If you access, interact with, or transact on any third-party website or service (even one that interoperates with Pumplify), you do so at your own risk. Any such interaction is solely between you and the third party. You should review the applicable terms and policies of any third-party sites or services you use. Pumplify will not be liable for any loss or damage of any sort incurred as the result of any dealings with third parties or as the result of the presence of such third-party links or resources on our Platform.
7. Risk Acknowledgment
By using Pumplify’s API and engaging in blockchain transactions, you acknowledge and accept the inherent risks associated with cryptocurrencies, blockchain technology, and decentralized finance. You agree that you are using these services at your own risk. Risks include, but are not limited to, the following:
Market Volatility: Cryptocurrency markets are highly volatile. The value of tokens or assets can fluctuate dramatically over short periods. You may incur significant gains or losses, and you bear full responsibility for any financial outcomes. Pumplify has no control over market prices or volatility.
Transaction Failures and Irreversibility: Blockchain transactions (e.g., trades, transfers, or smart contract interactions) are irreversible once confirmed. Transactions may be delayed, lost, or fail due to issues like network congestion, node failures, or insufficient funds/gas. Pumplify does not guarantee that any transaction you attempt via our API will be executed, confirmed, or completed. You are solely responsible for verifying the success of your transactions on the blockchain.
Security Vulnerabilities: The use of blockchain networks and related software (such as digital wallets, smart contracts, or decentralized applications) may involve security risks. Vulnerabilities or exploits in the blockchain protocols, smart contracts (including those on Raydium or Pump.fun), or your own security practices (like the protection of private keys or seed phrases) can lead to partial or total loss of funds or assets. Pumplify is not responsible for any hacks, breaches, or thefts affecting your accounts, wallets, or third-party platforms, even if you accessed them through our API. You are responsible for maintaining strong security measures (e.g., safeguarding your private keys, using reputable wallets, and not sharing credentials).
Regulatory and Legal Risks: Blockchain and cryptocurrency activities are subject to evolving laws and regulations in various jurisdictions. You acknowledge that your use of Pumplify and related activities could be affected by regulatory actions, such as new legislation, taxes, restrictions, or bans on cryptocurrency. It is your responsibility to understand and comply with any laws or regulations that apply to your activities. Pumplify does not guarantee that the API or any related services are lawful or available in any particular location.
Data Accuracy: Information retrieved or provided via Pumplify (such as market data, blockchain data, or third-party content) may not always be accurate, complete, or up-to-date. Pumplify will strive to provide reliable data, but does not warrant or guarantee the accuracy or integrity of data from third-party sources (like Pump.fun or Raydium) or from the blockchain. You should independently verify information before relying on it for any decisions.
You fully assume all risks associated with using Pumplify’s API, including the risks mentioned above and any other risks inherent in blockchain technology. Pumplify shall not be responsible for any losses you incur due to these risks. You agree that you have the necessary knowledge, experience, and risk tolerance before using the Platform or API.
8. User Responsibilities
When using Pumplify, you agree to fulfill the following responsibilities and obligations:
Compliance with Laws: You must comply with all applicable laws, regulations, and ordinances in connection with your use of the Pumplify Platform and API. This includes U.S. federal and state laws (given Pumplify’s U.S. base) as well as the laws of any country or jurisdiction relevant to you. You are responsible for determining whether your use of the API is legal in your jurisdiction and you agree not to use Pumplify if such use is prohibited or violates any laws.
Tax Obligations: You are solely responsible for calculating, reporting, and paying any taxes applicable to your use of Pumplify or any transactions or gains you realize through the API. Pumplify does not provide tax advice, and we will not be responsible for withholding or paying any taxes on your behalf (except to the extent we are required to collect taxes as described in Section 4). You should consult with a tax professional regarding your tax obligations.
Account Security and Credentials: If access to the Pumplify API or Platform requires an account, API key, or other credentials, you are responsible for maintaining the confidentiality and security of those credentials. Do not share your API keys or passwords with any unauthorized person. You must notify Pumplify immediately at our support contact if you suspect any unauthorized access to or use of your account or API credentials. Pumplify is not liable for any loss or damage arising from your failure to secure your account information.
Proper Use of the API: You must use the API and Platform only for their intended and lawful purposes. Follow any technical documentation, usage guidelines, or rate limits provided by Pumplify. Do not use the API in any manner that could damage, disable, overburden, or impair our services (or the networks connected to our services). You may not use any automated means (such as scripts, bots, or scrapers) to extract data or otherwise interact with Pumplify’s services in a way that violates these Terms or our instructions.
Good Faith and Cooperation: You agree to use Pumplify in good faith. If you discover any issue with the API (such as a bug or security vulnerability), you should report it to Pumplify and not misuse it for personal gain or to harm Pumplify or others. You will not falsely represent yourself as being associated with Pumplify, and you will not engage in any activity that reflects poorly on Pumplify’s reputation.
Failure to meet these User Responsibilities constitutes a breach of these Terms and may result in suspension or termination of your access to the API, as well as potential legal consequences.
9. Termination of Access
Pumplify reserves the right to suspend or terminate your access to the Platform and API at any time, for any reason, and at our sole discretion, with or without prior notice. This means we may revoke your API key or otherwise prevent you from accessing our services if we deem it necessary. Some circumstances under which we might terminate or suspend your access include (but are not limited to):
Violations: If you violate any of these Terms or engage in any prohibited use or unlawful behavior. Serious or repeated violations can result in a permanent ban from the Platform.
Security or Fraud: If we suspect that your account is compromised, or that you have engaged in fraud, abuse, or any activity that poses a security risk or legal liability to Pumplify or any third party.
Legal Requirement: If we are required to do so by law, court order, or at the request of law enforcement or other government agencies.
Discontinuation: If Pumplify chooses to discontinue the API or Platform services (temporarily or permanently). In such cases, we will make reasonable efforts to provide advance notice to active users.
If your access is terminated or suspended, you agree to immediately cease all use of the Pumplify API and Platform. You also agree not to attempt to circumvent the termination (for example, by creating a new account or using alternate credentials) without our express permission. Pumplify shall not be liable to you or any third party for any termination or suspension of your access, including for any losses of data or opportunities that may result. Sections of these Terms that by their nature should survive termination (such as indemnification, disclaimer of warranties, limitation of liability, and others) will continue to apply even after your access has been terminated.
10. Modifications & Updates
Pumplify reserves the right to change, modify, or update these Terms of Service at any time. We may also update or modify the features of our API or Platform, including introducing new functionalities or discontinuing existing ones. When we make changes to the Terms, we will update the “Last Updated” date at the top of this document. In some cases, we may provide additional notice to you of significant changes, such as via email or a notification on our website or dashboard.
Agreement to Updated Terms: Continued use of the Pumplify API or Platform after any modifications to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes. If you do not agree with any changes, you must stop using the API and Platform.
Material Changes: If a change to the Terms materially affects your rights or obligations, we may attempt to notify you (for example, by posting a notice on our site or sending an email to a contact address if you have provided one). However, it remains your responsibility to stay informed of the current Terms.
Updating the Service: Pumplify may also from time to time update the software, protocols, or interfaces of the API. Such updates may affect the way you access or use the API (for example, requiring you to use the latest version or to update your applications). We will not be liable for any issues arising from your failure to implement required updates.
By continuing to use Pumplify after updates to the Terms or service, you confirm that you accept the updates. If you have any questions or concerns about the Terms, please contact us before continuing use of the Platform or API.
11. Governing Law and Miscellaneous
Governing Law: This agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of the United States of America, and, to the extent not inconsistent with or preempted by federal law, the laws of the State of [Insert State], without giving effect to any conflict of law principles that would cause the laws of another jurisdiction to apply. (Note: Pumplify is a U.S.-based service, and these Terms are intended to be enforceable under U.S. law. If you are an international user, you still agree that U.S. law will govern the interpretation and enforcement of these Terms.) You and Pumplify agree that the exclusive jurisdiction and venue for any legal action or proceeding arising under these Terms shall be the state or federal courts located within the United States. You consent to the jurisdiction of such courts and waive any objections (such as inconvenient forum) to the exercise of jurisdiction over you by such courts.
International Use: Pumplify makes no representations that the Platform or API is appropriate or available for use in all countries. If you access Pumplify from outside the U.S., you do so on your own initiative and are responsible for compliance with local laws. Notwithstanding the governing law stated above, you will not be deprived of any mandatory consumer protections under the law of your country of residence (if applicable).
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. The invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law, reflecting the parties’ intention as closely as possible.
No Waiver: No failure or delay by Pumplify in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or privilege preclude full exercise of that or any other right, power, or privilege. Pumplify’s waiver of any breach or default by you will not be deemed a waiver of any subsequent breach or default.
Entire Agreement: These Terms (together with any additional policies or guidelines posted on the Platform, such as the Fee Disclosure, and any API documentation or usage guidelines provided by Pumplify) constitute the entire agreement between you and Pumplify regarding the subject matter hereof, and supersede any prior or contemporaneous agreements, understandings, or communications, whether written or oral, relating to such subject matter. You acknowledge that you have not relied on any representation, warranty, or statement that is not expressly set out in these Terms.
Assignment: You may not assign or transfer any rights or obligations under these Terms without Pumplify’s prior written consent. Pumplify may assign its rights and obligations to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
No Third-Party Beneficiaries: These Terms are intended for the benefit of the parties (Pumplify and the User) and not for any third party. No third party shall have any rights to enforce any term of this agreement.
Relationship of the Parties: Nothing in these Terms shall be construed to create a joint venture, partnership, employment, or agency relationship between you and Pumplify. You are an independent party accessing an API service.
Headings: Section titles or headings in these Terms are for convenience only and have no legal or contractual effect.
By using the Pumplify Platform and API, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by them. If you do not agree with these Terms, you must discontinue all use of Pumplify’s services immediately.
